User Agreement

This User Agreement ("Agreement") is between you and xaround and governs the use of the xaround mobile application and services provided through the Apple App Store, Google Play Store, and Huawei AppGallery. By installing or using the xaround app, you agree to be bound by this Agreement. If you do not agree, do not use the app.

1. Eligibility and Age Restrictions

You must meet the minimum age requirement for your region as determined by local content rating authorities:

Users below the minimum age for their region may use xaround with verifiable parental or legal guardian consent. Violation of age restrictions may result in immediate termination of your access.

2. Account Management

You may create an account using Google Sign-In or Apple Sign-In. You are responsible for securing your account credentials and notifying us of unauthorized access.

2.1. Username Policy

xaround reserves all rights to usernames within the app. We may reclaim, reassign, or modify any username at our sole discretion, including but not limited to usernames that impersonate others, infringe trademarks, are misleading, inactive for extended periods, or violate this Agreement or our Community Guidelines. You do not own your username and have no proprietary rights to it.

3. License and Restrictions

xaround grants you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes. Restrictions include:

• Modifying or reverse engineering the app.
• Commercial use without written consent.
• Violating applicable laws.
• Unauthorized access attempts.

4. User Content

You retain ownership but grant xaround a license to use your content within the app. Content must comply with this Agreement and our Community Guidelines.

4.1. Objectionable Content Policy

We have zero tolerance for objectionable content, including but not limited to:

• Obscene, defamatory, violent, or unlawful content.
• Content infringing third-party rights.
• Promotion, facilitation, or sale of illegal substances, firearms, gambling (including online casinos, sports betting, bingo, or poker), or prohibited goods.
• Content violating applicable laws or Community Guidelines.

xaround reserves the right to moderate and remove objectionable content.

5. Intellectual Property

xaround owns the app and its features, protected by intellectual property laws. Feedback provided by users becomes the property of xaround.

6. Third-Party Services

Your use of xaround is subject to the terms of the platform (Apple App Store, Google Play Store, Huawei AppGallery). xaround is not responsible for third-party content.

7. Warranty and Liability

The app is provided "as is" without warranties of any kind. xaround disclaims all implied warranties and limits liability to the maximum extent permitted by law. Aggregate liability is capped at $100.

8. Maintenance and Support

Minimal support provided; any legally required support will be handled by xaround.

9. Indemnification

You agree to indemnify xaround from claims arising from your use of the app, your content, or violations of this Agreement.

10. Governing Law and Dispute Resolution

This Agreement is governed by Malaysian law. Disputes will be resolved via arbitration by the Asian International Arbitration Centre (AIAC) in Kuala Lumpur, Malaysia. You agree to resolve disputes on an individual basis and waive any right to participate in class action, collective action, or representative action proceedings.

11. General Provisions

• This Agreement, together with the Privacy Policy and Community Guidelines, constitutes the entire agreement between you and xaround.
• By using xaround, you acknowledge that you have read, understood, and agree to be bound by this Agreement, the Privacy Policy, and the Community Guidelines.
• This Agreement may be updated periodically. Please check this page regularly to stay informed of any changes.
• If any provision is found to be invalid or unenforceable, the remaining provisions will remain in full effect.
• No failure by xaround to enforce any provision shall be considered a waiver. Assignment of this Agreement is permitted only by xaround.
• If you are accessing xaround via an Apple device or through the Apple App Store, you acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this Agreement, and that upon your acceptance of the terms of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.
